Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Gonow Play service operated by GoNow Productions ("we", "us", or "our"), registered as an Autónomo business in Spain, owned and operated by Jason Leven.

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. The Service

Gonow Play is an AI-powered in-store scavenger hunt platform available as a Progressive Web App (PWA). The Service allows players to participate in product discovery hunts at participating shopping centres, earn points, and redeem prizes. The Service is operated by and on behalf of shopping centre operators who are our clients.

2. Eligibility

To use the Service, you must:

• Be at least 16 years of age (or have parental consent if younger, where permitted by law)
• Provide accurate and complete registration information
• Have the legal capacity to enter into a binding agreement

3. Account Registration

You may register using Google Sign-In or an email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at info@gonowproductions.com if you suspect unauthorised access.

You may only create one account per person. Creating multiple accounts to gain unfair advantages in hunts or on leaderboards is prohibited.

4. Acceptable Use

You agree not to:

• Submit fraudulent, edited, or digitally manipulated photos
• Attempt to cheat, exploit bugs, or manipulate scores through any means including screenshots of screens, use of pre-taken photos, or AI-generated images
• Create multiple accounts or share accounts with other users
• Use automated tools, bots, or scripts to interact with the Service
• Interfere with or disrupt the integrity or performance of the Service
• Engage in any conduct that is illegal, harmful, abusive, or violates the rights of others
• Attempt to reverse-engineer, decompile, or extract source code from the Service
• Upload content that is offensive, illegal, or infringes third-party rights

We reserve the right to suspend or permanently ban any account found to be in violation of these rules, at our sole discretion and without prior notice.

5. Prizes and Rewards

Prizes are offered at the discretion of individual shopping centre operators. We act as a technical platform and are not responsible for the fulfilment, availability, or value of prizes. Prize availability, expiry, and redemption conditions are set by the relevant shopping centre and will be communicated within the game.

Prizes have no cash value and are non-transferable unless otherwise stated. We reserve the right to void prizes obtained through fraudulent means.

6. AI Scoring

Product submissions are evaluated by an AI vision model. Scores are based on the likeness between your submitted photo and the reference image. AI scoring decisions are final. We continually improve our verification system but cannot guarantee a specific score threshold will always be achievable.

7. Intellectual Property

All content within the Service — including but not limited to the software, design, graphics, brand names, and game mechanics — is owned by or licensed to GoNow Productions and protected by applicable intellectual property laws.

You retain ownership of any photos you submit. By submitting photos, you grant us a limited, non-exclusive licence to process those photos solely for the purpose of AI verification and anti-fraud checks.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

To the fullest extent permitted by applicable law, GoNow Productions shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising from these Terms or the Service shall not exceed €100 or the amount you paid us in the twelve months preceding the claim, whichever is greater.

10. Indemnification

You agree to indemnify and hold harmless GoNow Productions, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. You may delete your account at any time by contacting us at info@gonowproductions.com.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the revised Terms on this page. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Spain and the European Union. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Barcelona, Spain, unless mandatory consumer protection laws in your country of residence provide otherwise.
